1. Acceptance of Terms

By accessing or using AerlertWeather Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms constitute a legally binding agreement between you and AerlertWeather Inc.

2. Description of Services

AerlertWeather provides weather forecasting services including but not limited to:

• Current weather conditions and forecasts
• Severe weather alerts and notifications
• Radar and satellite imagery
• Location-based weather information
• Weather-related news and educational content

We reserve the right to modify or discontinue any aspect of our Services at any time without prior notice.

3. User Accounts

Account Creation

Certain features of our Services may require you to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account

Account Termination

We reserve the right to suspend or terminate your account at our sole discretion if we believe you have violated these Terms or applicable laws.

4. User Responsibilities

When using our Services, you agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated means (bots, scrapers, etc.) to access our Services without permission
• Interfere with or disrupt the Services or servers/networks connected to the Services
• Reverse engineer, decompile, or disassemble any portion of our Services
• Use our weather data for commercial purposes without obtaining a proper license

5. Weather Data Disclaimer

Our Services should not be used as the sole basis for critical decisions regarding personal safety, property protection, or business operations. For official weather warnings, always consult your local government meteorological agency.

6. Premium Services

Subscription Plans

AerlertWeather may offer premium subscription plans with additional features. By subscribing, you agree to:

• Pay all applicable fees for the selected subscription
• Provide accurate billing information
• Authorize us to charge your payment method for the subscription period

Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date. You may cancel your subscription at any time through your account settings.

Refunds

All sales are final. We do not provide refunds except as required by applicable law.

7. Intellectual Property

All content, features, and functionality available through our Services, including but not limited to text, graphics, logos, icons, images, weather data, and software, are the exclusive property of AerlertWeather or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from our Services without our express written permission.

8. Third-Party Links and Services

Our Services may contain links to third-party websites or services that are not owned or controlled by AerlertWeather. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

9. Limitation of Liability

To the maximum extent permitted by law, AerlertWeather shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

1. Your use or inability to use our Services
2. Any conduct or content of any third party on the Services
3. Any reliance on weather information provided by our Services
4. Unauthorized access, use, or alteration of your transmissions or content

10. Indemnification

You agree to defend, indemnify, and hold harmless AerlertWeather and its affiliates, officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

• Your use of and access to our Services
• Your violation of these Terms
• Your violation of any third-party right, including intellectual property or privacy rights
• Any damage caused by your reliance on our weather information

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes through our Services or by other means. Your continued use of our Services after such changes constitutes your acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising out of or relating to these Terms or our Services shall be resolved through binding arbitration in New York, NY, in accordance with the rules of the American Arbitration Association.

14. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and AerlertWeather regarding our Services.
• Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
• Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
